Our distinguished panelists include Oregon Supreme Court Justice Richard Baldwin, Oregon Court of Appeals Judge Joel DeVore, Oregon Deputy Solicitor General Paul Smith, and Willamette University Law Professor Jeffrey Dobbins. Section chair Cody Hoesly will moderate. The panel will discuss significant 2015 decisions from both appellate courts in diverse areas of law.

ORAP 16.50 “Bookmark” Issue

If you attended the Fall CLE, you may recall that a question arose during the CLE regarding the judges’ ability to see attorney-created bookmarks in Good Reader.  Good Reader is the program that the judges use on their e-readers to read briefs.  ORAP 16.50 encourages attorneys to use bookmarks and hyperlinks in e-filed briefs.  However, a question arose at the CLE regarding whether attorney-created bookmarks are actually visible in Good Reader.
The Section has worked with appellate court staff to resolve this issue.  Upon investigation, it has been confirmed that attorney-created bookmarks are visible in Good Reader.  They are not in the most obvious location, however, so court staff is working to ensure that all judges know how to find them in Good Reader.  We are glad this issue came to the court’s attention so that it could be resolved. 
Now that this issue is resolved, it is a good time to remember ORAP 16.50.  The Fall CLE materials are on the this website, including a “Handout—ORAP 16.50” that provides step-by-step instructions for adding bookmarks and hyperlinks to e-briefs.

CLE: “The Supreme Court Inside and Out”

The Oregon State Bar’s Business Litigation Section is pleased to present a distinguished panel to discuss the ins and outs of preparing and presenting argument before the U.S. Supreme Court and the unique decision-making process that results in precedents that impact us all.

It is the highest court in the land and the court of last resort for the privileged few whose legal issues are lofty and consequential enough for the Court to consider. There are unwritten rules of etiquette and an expectation of advocacy at its most polished.

The panel includes Oregon Supreme Court Justice Rives Kistler who is a former clerk to U.S. Supreme Court Justice Lewis Powell; Jeff Lamken, a partner at Molo Lamken in Washington D.C, who is a former clerk to U.S. Supreme Court Justice Sandra Day O’Conner and a former Assistant Solicitor General who has argued 21 cases before the U.S. Supreme Court; and Steve Wilker, a partner at Tonkon Torp who argued a case before the U.S. Supreme Court last year.

3:05-5:00 p.m. — CLE: “E-Briefing in Oregon.” An e-brief is more than a brief filed electronically. It is one strategically designed to be read electronically. Our fabulous panel—including Justice Kistler, Justice Landau, Judge Sercombe, Supreme Court Staff Attorney Lisa Norris-Lampe, and attorney Cody Hoesly—will discuss what Oregon appellate judges and staff attorneys like (and don’t like) to see when they read an e-brief. With practical demonstrations.

5:00-5:15 p.m. — CLE: Results of the Court of Appeals Performance Standards Survey. Judge Sercombe will discuss the results of this recent survey.

5:15-5:30 p.m. — A Brief Celebration of Justice Linder and Chief Judge Haselton. On the occasion of their upcoming retirements.

5:30-7:00 p.m. — Appellate Social. Mingle, mingle, mingle. Beer and wine hosted by Schwabe Williamson & Wyatt and Tonkon Torp LLP.

This panel on important 2014 decisions from our state appellate courts will feature Supreme Court Justice Jack Landau, Court of Appeals Judge Erika Hadlock, Oregon Solicitor General Anna Joyce, and Willamette Law Professor Jeff Dobbins. Supreme Court Adopts Permanent Amendments to Oregon Rules of Appellate Procedure

The Oregon Supreme Court and Court of Appeals have adopted permanent amendments to the Oregon Rules of Appellate Procedure (ORAP). The amendments will become effective on January 1, 2015. The rules that have been amended, added, or deleted are:
